Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and the term "you" refers to both you and that business.

2. Description of Services

Pulse is an AI-powered advertising intelligence platform that:

• Connects to your advertising accounts (Meta, Google Ads, TikTok, LinkedIn) via read-only OAuth
• Retrieves and analyses your advertising performance data
• Provides AI-generated insights, recommendations, and audits powered by Claude (Anthropic)
• Displays performance dashboards, creative analysis, and account health scores
• Stores your data securely within your workspace

The Service is provided on a subscription basis. Feature availability depends on your subscription plan.

3. Account Registration

You must register for an account to use the Service. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorised use of your account at support@nurdd.club
• Be responsible for all activity that occurs under your account

One account per person or business entity. Creating multiple accounts to circumvent usage limits is a violation of these Terms.

4. Subscriptions and Billing

Plans: We offer multiple subscription plans (including a free tier). Paid plans are billed monthly or annually as selected at checkout.

Payment: All payments are processed by Razorpay. By subscribing, you authorise Razorpay to charge your payment method on a recurring basis.

Auto-renewal: Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date from Settings → Billing.

Refunds: We offer a 7-day full refund for new paid subscriptions. After 7 days, payments are non-refundable except where required by applicable law.

Taxes: All prices are inclusive of 18% GST (Goods and Services Tax) where applicable. You are responsible for any other applicable taxes.

Price changes: We will provide at least 30 days' notice of any price changes for active subscriptions via email.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe any third party's intellectual property, privacy, or other rights
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Access or probe any system or network in a manner that could cause damage
• Resell, sublicence, or distribute the Service to third parties without our written consent
• Scrape, harvest, or systematically extract data from the Service
• Attempt to circumvent any security or access-control mechanism
• Upload or transmit any malware, viruses, or malicious code
• Use the Service in any way that could harm Nurdd's reputation or disrupt the Service for other users

6. Third-Party Integrations

The Service integrates with third-party advertising platforms (Meta, Google, TikTok, LinkedIn). When you connect an account, you:

• Authorise us to access that account with the permissions you grant (read-only)
• Remain bound by the terms of service of those platforms
• Acknowledge that changes to those platforms' APIs may affect Service functionality

We are not responsible for the actions, policies, or availability of third-party platforms.

7. Intellectual Property

All content, features, functionality, design, and code of the Service are owned by Nurdd Solutions Private Limited or its licensors and are protected by Indian and international intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your own business purposes, subject to these Terms. No other rights are granted.

You may not use our name, logo, or trademarks without prior written consent.

8. Your Data

You retain full ownership of your advertising data and any content you create within the Service. By using the Service, you grant Nurdd a limited, non-exclusive licence to process, analyse, and display your data solely for the purpose of providing the Service to you.

We do not claim ownership of your ad account data. We do not share your specific account data with other Pulse users or use it to train AI models without your explicit consent.

9. AI-Generated Content Disclaimer

The Service uses Claude (Anthropic) to generate analysis, recommendations, and insights. You acknowledge and agree that:

• AI-generated content is for informational purposes only and does not constitute professional financial, marketing, or legal advice
• AI analysis may contain errors, hallucinations, or outdated information
• You are solely responsible for any advertising decisions made based on AI-generated recommendations
• Nurdd is not liable for any outcome resulting from acting on AI-generated analysis

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. Nurdd disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nurdd's total cumulative liability for any claim arising from or relating to these terms or the service is limited to the amount you paid Nurdd in the three (3) months immediately preceding the claim. In no event shall Nurdd be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nurdd Solutions Private Limited, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) any content you submit to or through the Service.

13. Termination

By you: You may cancel your subscription at any time from Settings → Billing. Upon cancellation, your paid access continues until the end of the current billing period. Account deletion removes all your data within 30 days.

By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if continued operation creates legal or security risks. We will provide reasonable notice where possible.

Upon termination, all rights granted to you under these Terms cease immediately.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute informally by notifying the other party in writing and engaging in good-faith negotiations for at least 30 days.

15. Changes to These Terms

We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice within the Service. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
